FDA revoked the authorization of Red 3 in food on January 15, 2025. Products must be reformulated by January 15, 2027.
Red 40 (E129) and Yellow 6 (E110) are among six petroleum-based dyes FDA is asking manufacturers to remove by the end of 2027. The phase-out is voluntary: the dyes remain approved.
California
The California Food Safety Act (AB 418) bans Red 3 (E127) in food sold in California from January 1, 2027.
The California School Food Safety Act (AB 2316) bars Red 40 (E129) and Yellow 6 (E110) from food served or sold in public schools from December 31, 2027.
West Virginia
West Virginia HB 2354 has barred Red 3 (E127), Red 40 (E129) and Yellow 6 (E110) from school nutrition programs since August 1, 2025. A statewide ban due January 1, 2028 is on hold under a preliminary injunction (December 23, 2025) while the state appeals.
European Union
In the EU, food containing Yellow 6 (E110) and Red 40 (E129) must state that it "may have an adverse effect on activity and attention in children."
In the EU, erythrosine (E127) is allowed only in cocktail cherries, candied cherries and bigarreaux cherries in syrup.
