West Virginia

West Virginia HB 2354 has barred Red 3 (E127), Red 40 (E129), Yellow 5 (E102) and Blue 1 (E133) from school nutrition programs since August 1, 2025. A statewide ban due January 1, 2028 is on hold under a preliminary injunction (December 23, 2025) while the state appeals.
